March 31, 2017 UPDATE


2017 REGULATORY UPDATES 

HM-215N was re-released on March 29, 2017 by US DOT Pipeline and Hazardous Material Safety Administration (PHMSA). This final rule was originally issued in January 2017, then withdrawn due to a federal government Regulatory Freeze. After a government review, it has been released. The lithium battery requirements in the newly release version are identical to the version released in January.

This final rule harmonizes with many of the 2017 International Air Transport Association (IATA) Dangerous Goods Regulations, 58th Edition and the International Maritime Dangerous Goods (IMDG) Code, Amendment 38-16.  

 New DOT (49 CFR), IATA and IMDG rules now in effect include:):

·         Phase in of new Lithium Battery Class 9 label (see illustration below)

·         Phase in of new Lithium Battery handling mark for lithium batteries shipped per an exception (see illustration below)

·         Consignments of more than 2 packages of small lithium batteries contained in equipment must be marked with the lithium battery handling mark.  Note: this requirement is mandatory for air transport and optional until 31-Dec-2018 for ground and vessel.

·         Elimination of the requirement to have an emergency document accompany a shipment of small lithium batteries

2017 AIRLINE RESTRICTIONS.

For air transport many airlines have issued more restrictive requirements and/or prohibitions on accepting lithium batteries for transportation.   Most notable operator variations include:        

·         FEDEX and UPS will not accept UN 3480, Lithium Ion Batteries shipped according to IATA PI 965 Section II; and

·         FEDEX and UPS will not accept UN 3090, Lithium Metal Batteries shipped according to IATA PI 968 Section II

Starting in 2017, the above shipments must be shipped according Section IA or IB of their respective PI.    This means a declaration is now required for air shipments of small lithium batteries without equipment via FEDEX or UPS!

FEDEX also requires additional marking requirements if using the old version of the lithium battery handing mark (“CAUTION label”).


MARCH 2016 LITHIUM ION BATTERY RESTRICTIONS

In March of 2016 ICAO/IATA issued very stringent new rules for shipping UN 3480, Lithium Ion Batteries for air transport.   Lithium ion batteries without equipment shipped according to Packing Instructions 965 Sections IA, IB or II are

  • prohibited for passenger air transport

  • the state of charge of the batteries and cells may not exceed 30%
